Legal Question in Credit and Debt Law in Michigan

Threaten to Sue

I owe my ex gf some money. I've been paying her as agreed. Just to be troublesome, she's threatening to take me to court even though I haven't breached our contract. Can SHE get in trouble if she tries to do this? Can I countersue for anything?

Re: Threaten to Sue

Yes, if you are paying her as agreed. If you are paying her as agreed, then you are complying with your contract. Her promise under the contract is to abide by the terms of the contract and allow you to pay as agreed. If she sues you when you are in compliance, then she is in breach of contract. You can sue her for your damages resulting for her breach. Throw in a count of frivolous lawsuit as well and she will be in big trouble with the court.
