Legal Question in Credit and Debt Law in Michigan
unsettled bill
Can a law firm who bought a 11 yr old electric bill come and sue us now even though I disputed this bill 11yrs ago with the company and they never got back with us? The firm also says that it has sent several letter to us since 2004 but they apparently were sending them to our old address the bill was from. When I questioned them why they would send it there and not to our current address, they said they did not have our new one then.I then told them if they could get my current phone number they should have been able to get my current address. What I would like to know is can they legally sue us for this after all this time, and can they use this against us on our credit report? We had paid all our outstanding debts we had due to our move back in 95 off along time ago and I don't feel they should be able to come back after 11yrs and claim you owe this money with no proof. I asked for the time period this was suppose to have occured and I was told they would have to research it. They told me that if I paid them what they wanted they would stop the filling on this that is due to happen on thursday, but if we don't pay we will probably end up paying the initial amount plus interest and court cost. What should we do?

Re: unsettled bill
No, they should not be able to sue on this debt if it more than six years old based on the facts provided. You can send them a letter telling them the statute of limitations has expired, and you do not validate this debt.
I also think they may have violated the FDCPA. This means you can sue them for money damages. Call me if you are interested in pursuing a claim. You would not be responsible for attorney fees.
