Legal Question in Credit and Debt Law in Michigan
utility bill and junk collectors
In late 2001 I had a dispute with the phone company while living in Michigan, and refused to pay the bogus bill. Now, I'm getting repeated phone calls from a junk debt collection group located in MI. I've read about their tactics and I don't answer the phone. The statute of limitations in MI apparently runs out in the next few weeks, once it does, will these calls stop? What can I do if they keep calling? They have already sent me a letter threatening to sue, but I honestly don't believe I ever owed this money in the first place, and I surely don't owe these predators anything. I just want them to stop calling me. Also, I now live in Missouri, so I don't know if that changes matters any.

Re: utility bill and junk collectors
You probably signed a contract that required Michigan as a forum for any disputes.
In order for them to preserve their claim they must file suit against you before the statute of limitations runs. Just because it does stop running, doesn't mean they will stop calling.
Send these predators a letter indicating that you dispute the debt and even if you did owe the money, you have no way of paying it. Indicate that they must stop calling you or you will sue them for violating the fair Debt Collections Practices Act.
If you would like me to send a letter for $75.00, I would be glad to take care of this for you. Please contact me if you are so inclined at www.lawrefs.com. If you would like additional free legal advice, please do not hesitate.
