Legal Question in Criminal Law in Michigan

Hi, I'm 26 and was caught shoplifting some nailpolishes (silly and stupid, i know) totalling $71.86. The LP officer had me sign a voluntary statement, gave me a civil demand letter for $200, called the cops and had me arrested. I'm charged with Retail fraud 3rd degree and have a court date on the 28th. This is my first ever offense besides a few speeding tickets, and recently graduated from college. I don't even know why i did such a stupid thing an deeply regret it. I have definately learned my lesson. What can i expect in court? I would really like for this to be on my record as i am job hunting at the moment. I understand that since this is my first offense i would be eligible for a deferred sentence or a diversion program, does that mean this won't show up on a background check? And do I HAVE to hire a lawyer for those options? I don't know if I can afford one. Any help/answers will be appreciated. Thanks.

Opportunities for diversion or deferred sentences depend on the prosecutor's office or court or individual judge you're in front of. There's no automatic "first offense" diversion built into the shoplifting laws. But some prosecutor offices have them available, or some judges will do things like this ... especially when the person is too old for something like the Holmes Youthful Trainee Act. (No offense, but you're too old for HYTA status.)
