How offen does the judge put people in jail for retail fraud?

Your question cannot be answered. We know NOTHING about the case facts, the defendant's background, etc.

First, WHICH judge are you talking about? Each judge has his/her own sentencing tendencies, and your case might be in front of a judge that sends a higher percentage of people to jail than other judges.

Second, what is your full criminal record like? If you have a spotless / clean record up to this case, the odds of a jail terms are small (but not imposiible). If you have a lot of priors (especially theft priors) or poor performance on past probations, you are more likely to go to jail.

Also, did you pay all restitution already? You are going to have to pay full restitution anyway. You cannot avoid that. So why not pay it back before you are even convicted or sentenced? That'd be a nice showing of good faith that might soften the judge up.
