Legal Question in Criminal Law in Michigan

My 18 year old daughter was put on probation for retail fraud, she has no other criminal record however she has violated her probation and has been charged again with retail fraud. She is a college student and I am afraid that jail time will cause her to have to drop out of school. does anyone have a guess at what a judge might do in this situation?. She was charged with retail fraud 2nd in Troy Michigan

She desparately needs a good local lawyer and some mental health treatment immediately. I have an office right near the courthouse in Troy and am in that court many times a month. I would be happy to help her. Visit www.kliszlaw.com to get started. Tim Klisz

Depends on her Judge. Is it Judge Martone, Drury or Bolle. If former, she may have some obstacles. I am in that Court tomorrow morning. feel free to give me a call if you should have any questions or require legal representation for your daughter. Daniel Hajji 248.865.4700

Assuming she pleaded under HYTA for her first Retail Fraud which is typical in the 52-4 , she would have had her case dismissed had she successfully completed her probation - leaving her with no criminal record.

However, violating her probation with the same offense (RF2) [over $200] not only violates her probation, but will likely cancel her HYTA which means she will have two retail fraud convictions on her criminal record for the rest of her life - making her college education a complete waste of time and money as she will be essentially unemployable.

She needs effective help right away. Troy is my home court for the last 20 years and my office is one mile north of the court.
