my 12 year old son..

My son has pendingassult charges.What is the worst he could face? he has never been in trouble before.

Your son is 12? Then he's facing a juvenile delinquency petition. He is not facing "adult court" sanctions (jail, fines, etc.). Juvenile court focuese on rehabilitation, not punishment.

"Detention" is used only to safeguard the public from the child, or the child from himself or the public. The VAST majority of delinquency cases never result in detention/lock up.

In all juvie court cases, the court has a range of disposition (sentencing) options ... from a warning ... to probation (usually with the child living in the parent's home) ... to probation w/ the child being placed in foster care (if the child cannot be safely kept in the parent's home) ... to plaement in a residential treatment program (worst-case).

If this is a first offense, and little to no injury to the victim, the court might well agree to put your son on "consent calendar" status, which gives the court the power to dismiss the case after all the informal probation terms have been completed.

I recommend that your son talk to a lawyer that handles delinquency cases in your county ... someone who knows what your judges tend to do on these cases.
