Legal Question in Criminal Law in Michigan

My 12yr old stepson is being charged with 20 felony counts for a B&E, the judge also stated that when he turns 18 his record will not be expunged. Can they really do this to a 12 yr old just for breaking into an abandoned building with 2 older kids and breaking a window and spray painting a wall? We cannot afford a lawyer and we are afraid that with the racism that is in the northern region of Michigan that a court appointed lawyer would do no good service to our son. Any advise would be greatly appreciated!

Dear Melissa,

Unfortunately this is true, a burglary will remain on his record even as an adult. These cases can be turned around however if you can get your stepson into a diversion program. So long as he does not have a criminal history already he should qualify for a program that if completed, will get the charges against him dismissed. Public defenders are poor, especially in smaller towns, however, any attorney worth his salt will fight to get this program or a similar one to ensure this young man does not live the rest of his life harmed by a stupid act.
