Accidental shooting by a minor

Hi, My question is if tw minors (children between the age of 5 - 8) are playing with a gun that they gained access to in the home go off and one of the children dies, what will happen to the one that shot the gun. If it's an accident then wouldn't the accountability be on the parents for not securing the gun? If the child is taken from the home until 18, they won't have a record will they. I would think that something like that would be expunged because of the age of the child when it happened.

it depends on the prosecutor - whether they will press charges or not, and whether the child will be charged as a juvenile or an adult. if the authorities do decide to press charges, I strongly recommend obtaining a lawyer who can assist the parents of the child being charged - this is not something the child wants on his/her record for the rest of his/her life.
