Legal Question in Criminal Law in Michigan
armed robber tried as an adult
My nephew, who is a minor, has been charged with armed robbery, alone with three other boys. The judge denied a request by the prosecutor to reduce the charges to unarmed robbery. My nephews attorney indicated that the judge could enter a 0 prison sentence for the robbery but for the gun charge it will be a mandatory 2 years. My question is 1) why would my nephew be the only one charged with the gun when the possession of the gun was never established and 2)does MANDATORY means no parole?

It is difficult for me to tell you why the prosecuting attorney chose to charge your nephew. If your nephew is sentenced to a mandatory 2 year minimum on the gun charge, he will do 2 years at least.
