Legal Question in Criminal Law in Michigan
I was arrested in 2001 for alleged domestic violence against my ex-wife. The prosecutor and magistrate both agreed I should have been arrested and denied the police dept arrest warrant. I was released immediately and no charges were ever filed. My new wife and I recently started the process to become a licensed foster care home. I went to the local police dept. and a records serach showed that 2001 arrest as a criminal record. The licensing agency asked me to get the disposition of the arrest at which point the Deputy Chief of Police claimed I was guilty of that alleged offense and proceeded to work directly with the agency to personally so to it I was disqualified from the licensing process. My wife and I have since worked through the licensing concerns but I want those 2001 arrest records destroyed so no member of this same police dept. can maliciously use the info against me at some future date. Can I contact them and request that removal and what might my chances be of succeeding? Thanks so much....blessings
