Never been arrested before...

A family member got arrested and was accused of trespassing and of assaulting a police officer. My family member has never been arrested before, and is not violent whatsoever. Is there a possible way that these two charges can both be dropped?

It's always interesting that the "family member" never makes the inquiry. It comes second hand from someone convinced that their loved one has been has been wrongly charged because the family member has belatedly given her his self-serving version of the incident after he's sobered up.

More likely is the reality that this is the first time the "family member" has finally been caught for assaultive behavior.

Being arrested before is not a prerequisite for a current arrest.

The prosecutor didn't approve the arrest warrant for nothing. Your family member needs a lawyer.
