Legal Question in Criminal Law in Michigan
Never arrested, never recieved summons, what do I do?
I was given a paper at Kmart for retail fraud, 3rd degree (worth $40), and told to call the prosecutor the next day. He told me that I'd receive a paper stating to turn myself in, no bond, would be booked and released with a court date that day.
It has been two months, nothing has been recieved. I called the Madison Heights police dept and was told they don't see any warrants.
I plan to be under the HYTA and I will be 21 (ineligible then) in november. What is going on? I've heard of this happening to people before- never being summoned/charged.
I'm scared- I need to be under HYTA and not be convicted or my nursing program will go to waste!

First, you cannot decide that you'll be "under the HYTA." Second, you should not practice law just like a lawyer shouldn't practice medicine or nursing. You're bound to make serious mistakes!
If this is extremely important to you, I strongly recommend you hire an experienced and aggressive attorney to help you through this. The attorney is much more likely to get a good result that you are.

Your wait is not unusual. The system is underfunded and overloaded. KMart is also slow I've got one guy whose been waiting for 3 months on an RF III.
To relieve you anxiety soewhat, HYTA eligibility is measured by your age (20) on the date of the crime.
HYTA is not always a given, but is discretionary with Judge Turner who usually grants it for newbies in the criminal system.
However, HYTA may not be your best alternative. Employment screening services can detect HYTA. There are other ways.
