Assault and Battery

I was arrested for domestic violence and taken to jail overnight and then taken to a Hospital for a mental evaluation and stayed for 7 days. I was covered with bruises and the victim had no bruises, but yet I was the one charged. My daughter the victim was sent a letter stating at least 3 charges are pending, wanting the victims input. I have not received any thing from the court. How do I obtain information about my case, since I had no knowledge that I was being charged of anything. This incident occurred on Oct 4,07, My daughter received the letter from the court the second week of January of 08. I thought that the charges were dropped since I never received any notification of any charge. I would like to resolve this matter, I just need to know whether I am being charged or not.

The 2nd reply suggested that you call the district court clerk. I'm not too sure that the court clerk will tell you anything about a complaint having been filed.

The advice that my office gives people (since we do not tell them whether an arrest warrant is pending) is to contact the police agency that investigated the case. If the incident was in a city/village with its own police department contact them, otherwise contact the county sheriff or state police. They would know if a charge had been issued by the prosecutor, and whether the court had authorized an arrest warrant.

If you have been charged, you should go to the district court ASAP to be arraigned. If not, you could be arrested at any time ... usually when it is the least convenient.

If you daughter got a letter from the prosecutor's office, you are probably being charged. You should have an experienced and aggressive attorney involved in your case.

If you call the district court in the city of your arrest and ask for the criminal clerk, you'll find out if you are being charged and be given further information.
