Attemped murder?

2 criminals were breaking into the next door neighbor's house. I saw the 2 criminals coming out of the house carrying belongings of the person who lived in the house next door I revealed my weapon (of which I have a legit CCW and is a registered gun) I asked the criminals to get on the ground until the police arrived. I proceeded to call the police as I held the criminals. The criminals proceeded to run in different directions and I fired at one in order to prevent him from running further. He was shot in the leg and was taken to the hospital. I am not being charged with attemped murder. Is this a fair charge?
