Legal Question in Criminal Law in Michigan
My boyfriend got charged with larceny over 1,000 under 20,000 a 10 year felony, breaking and entering with intent a 10 year felony, and conspiracy a 5 year felony. He's 22 and has no previous felonies. What's the chances he's going to get the whole 25 years if he takes it to trial?
1 Answer from Attorneys
In almost all cases, when charges / cases are grouped together in one sentencing event, the different convictions are served concurrently (all at once), not consecutively (back to back). So I'm 99% sure that he would not serve 25 years. Here, the 10-yr felonies would likely drive the bus and have the more serious sentencings and the other charge would be served at the same time. Felony sentences are heavily influenced by calculations of the sentencing guidelines, which factor in criminal history, number of felony charges in this sentencing, and a variety of variables focused on the current charge. His attorney will review those figures with him, which gives a preview of the likely minimum incarceration time.
