Neil O'Brien Eaton County Special Assistant Prosecuting Attorney

You think his felony car theft charge should be dropped because his girlfriend is pregnant??! No, not for that reason. But, regardless of the crime, "jail time" is always a real possibility (and is supposed to be some deterrent -- meaning that people might decide to NOT do the crime if they might do "jail time"). The practical reality is that without knowing more about the case facts, more about your boyfriend's past adult and juvenile record, more about what the victim wants, more about whether this was a lark or something more, knowing more about the judge it'll be in front of, knowing more about the plea bargaining tendencies of that prosecutor's office, etc ... we can't answer your real question. One possible option (depending on his past record and the judge's tendencies) is for the case to be handled under the Holmes Youthful Trainee Act (HYTA) where the charge could be dismissed after successul completion of probation. He wouldn't be able to use it if he was 21 or older when the crime happened, so he's got that going for himself. He should talk with an attorney about applying for HYTA.
