Legal Question in Criminal Law in Michigan
Hi. Currently, my boyfriend is in jail in Monroe county MI. I was wondering what you thought was would happen at court. Here is a little of his past history...
He went to jail in 2005 for running into someones house that was beatin up their girlfriend (he was friends with the girlfriend) and punched the kid in the face. He went to prison for 2 years while everyone else that went in the house with him only went to jail for 1 year or less, he kind of got the short end of the stick. Then he got out in 2007 and has been on parole ever since. Then him and his friend were working about 4 months ago and his friend traded a guy a set of speakers for this guys phone, while my boyfriend never even got out of the car, infact he didnt even know anythin about the phone. Then when they pulled out of the parking lot they got pulled over down the road, the cops searched the car and found the phone in the center council of the car. My boyfriend asked his friend where the phone came from and his friend said he traded the speakers for the phone, it was a small crappy phone that cost MAYBE 100 or 150 dollars. Anyways when my boyfriend told the cops he didn't know anything about the phone and the guy even said he never spoke to my boyfriend they still arrested him. Well his friend got arrested to and his friend went to jail over night and got out in the morning. My boyfriend sat in jail for 4 days because he had a parole hold on him and he couldnt get that realsed without the charges being droped. Then while he was stilll in jail his friend went down to the parole office and talked to his parole officer. He wrote a legal statement infront of the parole officer that my boyfriend had no idea about the phone and didnt even talk to the guy. So his parole officer let him out of jail and charges were pending still. Then when he went to go get realsed from parole last wednesday Monroe showed up and arrested him again. They said he had court on Sept 15th and never showed up, but we never got anything in the mail for them, otherwise we would have went. So now he is in jail and his parole officer gave him a copy of his friends statement to give to the judge and his court date is on Nov 8th.
So I was wondering what is going to happen at court? In situations like that if there is evidence stating that he had nothing to do with it then will charges be dropped? What will happen to him? His parole officer said she is not going to send him back to prison because she believes that my boyfriend had nothing to do with this whole mess and its just one big misunderstanding.
