Breaking and entering in MI

My 20 year old recently got arrested with breaking and entering into a local car dealership with intent to break into company safe. He and ''frend'' had $65 on them when they got caught and they tried to flea the scene. My brother has always been a great guy and has a very good rep in our town. Dont know where this behavior came from but he has a ton of ppl willing to give good character witnesses. First offense and completly clean record. What are the chances he could go to jail?

In what county is he charged? That is the most important question that needs to be answered. Other lawyers may not share that advice.

He could definitely go to jail (probably as a condition of a probation order). But you should make sure he gets an attorney (court-appointed or retained), and the attorney should explore whether your son's case could be handled under the Holmes Youthful Trainee Act where the judge could dismiss the case after successful completion of probation. It's a discretionary call by a judge to give him HYTA status, and it may depend on which judge gets the case, etc.

So, be more concerned about the long-term effects of a criminal conviction on his record, and less about the short-term consequences of a punishment imposed for his criminal behavior. He's not a child anymore, mom. He's an adult and has to take responsibility and deal with the consequences of his decisions.
