Breaking and entering a motor vehicle

A car was broken into in a bar alley. The police said they found my fingerprint in and on the car. THey say I can be charged with breaking and entering MCL 750.110 I thought the crime fall under MCL 750.356a under 1,000. The crazy thing is that I honestly didn't break into the car.

MCL 750.110 is B&E Building, so "they" were mistaken.

There are several "B&E Auto"-type crimes that a prosecutor can choose from. Some are misdemeanors, some are felonies. With the limited facts you gave us (e.g., was there damage to the car, what was taken, etc.), it's hard to predict what might be issued.

The prosecutor, not the police, decide what charges to bring ... and when. Your fingerprints being IN the vehicle presents pretty strong evidence against you ... unless there is an innocent explanation, like you're a friend of the victim and had just been an invited passenger in the car earlier that day.
