Legal Question in Criminal Law in Michigan

If someone was to be caught stealing from a department store, can they be prosecuted even though it is their first time comitting a felony? Would they be released with a warning or would it have to go through their district prosecutor which entails fine and with the possibility of a court case?

Any time you committ a crime, you can be prosecuted. There are many factors that determine the penalty for committing a crime. You can read more about this at:

Also, be VERY cautious about any attorney that tells you "I'll keep you out of jail" or promises you any other specific results of a case. It is unethical for an attorney to make promises and promising case results in advance is not possible.

If you were under 21 when the retail fraud happened, you should look into having your case resolved with the Holmes Youthful Trainee Act ... where you're put on probation and the judge has the power to then dismiss the charge after successfully completing probation. (The probation terms can include jail, community service, etc, so it isn't a totally pain-free thing.)
