Legal Question in Criminal Law in Michigan
Charge: Larcency by Conversion. Told Plantiff Where Item is!
I have been charged with Larcency by Conversion, value over $1000 but not exceeding $20,000 in Ingham County, Michigan. This is what happened.
I offered to fix an item for a business acquaintance. Took the item to be repaired, and the total for the repair came to $600. Didn't have the money to get it back, so I notified the owner of the item. He is now claiming that I took it under false pretenses and proceeded to pawn it off. My problem is, I gave the item to a worker of the store, not the owner. The worker wasn't suppossed to fix things on the side, but was doing a favor. Therefore, the owner is claiming he does not have the item (worker tells me he does). I know all this sounds horrible, but my basic question is this....
The item in question was a watch suppossedly valued at $3000. However, I believe the watch was a fake, and know that it needed severe mechanical repair, and minor cosmetic repair. I realize I should get an attorney, and plan to. But is it likely that I can convince the judge that the item was worth less than $1000 so that the case at least gets brought down to a misdemeanor? Right now it is a Class E Felony. Thank you.
