Legal Question in Criminal Law in Michigan

If a ci set someone up in order for that person to get convicted does he/she need to be caught red handed? Or if the drugs are found in the police car can they charge you with it after searching you multiple time including strip search not to mention the k-9 was involved?

Your issues are handful. In short, the Constitution gives us 4th amendment protections. The 4th Amendment protects you against unreasonable searches and seizures, especially in your home but a bit less in matters involving a car. There are limitations for an officer to search your car. They must have probable cause to search. A CI's information that led to pulling you over, etc... must be corroborated. Feel free to contact us at 248.865.4700. Ask for Dan Hajji.
