Depends on his sentencing guidelines. Just before the sentencing and after his conviction by Judge or Jury, he will be sent to the probation dept for interview and scoring. It is basically scoring of his offense variables(OV)and prior record variable(PRV). After the probation dept scores him, the Judge then will impose a sentence within that guideline range. Sometimes, a Judge may go below or higher than the range in the guidelines, depending on the circumstances of the case/defendant. Daniel Hajji 248.865.4700
