Legal Question in Criminal Law in Michigan

i was in court back in january 2010 for a felony of larceny in a building iwent to court and th judge dissmised it for with out a resonable dought i call the court house to have them take this off my recourd they said it takes five years i told them i wasent convited it was throne out but they said it didnt matter it has to be on there for five years also i was wanting to no if i can sue the person i worked for that accused me of this thanks mike

Assuming you want to do this on the cheap, go to the criminal clerk and get a copy of the last paper filed in your case. Take the paper to the judge's clerk and ask the clerk to have the judge explain it to you.

Generally you cannot sue a person that was the cause of a criminal matter being brought against you. However, if you were not convicted and the case was dismissed, you might have a case for Malicious Prosecution or Abuse of Process. However, to have those types of cases, you must show that there was absolutely no probable cause for you to be charged and that the person did it out of some sort of specific hatred or malice towards you.
