Legal Question in Criminal Law in Michigan
Criminal & Immigration Laws
I have lived in Michigan for the last 4 and a haf years and I got my green card about 2 years ago under EB1 category. About a year ago, our divorce finished. Now I received a letter from the immigration for deportation( I pleaded 'no contest' in the spousal abuse case under MCL 769.4a). Now my wife(not a permanent resident) wants to marry me again.
If I want to withdraw my 'plea' back and if she wants to withdraw her charges, can the District Court Judge throw my case?
Can Judge punish my wife for wrongly alleging?
If the Judge overturn the earlier decision (no jail term, but only probation for 6 months), can immigration judge will allow me to stay in this country?
Thank you for your reply.
