criminal sexual conduct

I might be facing charges for intercourse with a minor 13-16 she lied about her age and said she was 17 what are my choices and options? also there is a warrant for my arrest if she did not file a complaint until 2-3 weeks after the alleged incident how could there be any proof of penetration to cause the warrant?

Unfortunately, they can use her statement against you. More times than not, these crimes are "he said, she said." there are a few options you need to consider. The "victim's" statement can be used against you. You will want counsel with you when you turn yourself in - and in any police interview. Always remember that your statements can be used against you in court.

The prosecutor can issue a warrant based on any reasonable information. The minor may not have said anything to the police. Often it is a parent or school counselor who initiates the investigation resulting in the warrant.

You may be contacted by the police even before a warrant is issued. The officer will, in a friendly manner, ask you for your side of the story in order to clear up what may be a "false" accusation. At this point you should thank the officer and reply that you have nothing to say because anything you say will be held against you - even your explanation that you weren't aware that the girl was underage.

You should then immediately contact a lawyer. If a warrant has been issued, you are subject to immediate arrest at any time. Your defense will be much more successful if you voluntarily surrender after you retain counsel. If you need any further assistance, I can be reached at 248-680-1133.
