Criminal Sexual Conduct 2nd Degree
My fiance is being charged with CSC 2 & 4. The events that are making the charges stick are falsified by the ''victim''. While there was minimal contact between my finace and the ''victim'', nothin would constitute these type of charges. We have retained a lawyer who has appeared at an arraignment on my fiance's behalf. Other than that we don't knowwhat he has done on his behalf but is requesting an additional $5000! The laywer tells us to stay calm and not worry. However, he adds that as long as the ''victim'' says it happened, it did. My fiance is facing jail time, has been expelled from school, possibly being placed on the sex offender list, and our 2 children are facing possibly losing their father. Neither of us have ever been in trouble with the law and are lost in the process. We have no choice but to trust the lawyer at this point. My question is what are the chances of us beting this in a he said/she said case? How to we verify that the lawyer is doing what he can and should be on my fiance's behalf? What do we do with the pre trial a 11 days away!

What your lawyer is telling you is that it is Michigan law that an unsubstantiated victim's accusation is enough to charge anyone with CSC and,unrebutted, may be enough to convict.
Your lawyer's job is to defend your fiancee by rebutting the charge, neutralizing it, or plead it out.
I can't offer any advice on the substance of the charge since a fiancee is seldom candid when explaining his contact with the victim to his girlfriend.
