If the sexual conduct occurred when the "other girl" was already 16, then there'd have to be evidence of force, coersion, etc. involved. Michigan's "age of consent" is 16.

If the other girl was 15 or less when any of the sexual conduct occurred, then she had no ability/authority to consent to the sexual conduct. That's when "statutory rape/sexual conduct" kicks in.

Your daughter should consult ASAP with a criminal defense attorney who handles CSC cases. This is a serious charge that could require your daughter to register as a sex offender.

Not every prosecutor would issue a charge when there is an on-going relationship between people separated by just 2 years. But, prosecutors CAN issue charges in these circumstances (if one of them is under 16, or there is force/coersion/incest involved).
