How can I get my record expunged?

In addition to the previous answer's information re: waiting 5 years after the sentencing date, and that this can be your one and only prior criminal conviction (misdemeanor or felony), a few other things to keep in mind:

Not all CSCs are eligible for expungment (setting aside a conviction). Statutes have carved out some crimes that cannot be expunged.

"Life" felonies cannot be expunged. CSC 1st Degree is a felony carrying up to Life.

Other CSC crimes that cannot be expunged are CSC 2nd Degree, CSC 3rd Degree, and Assault With Intent to Commit CSC.

You should consult with a defense attorney who handles CSCs and expungments to thoroughly review your prior record and your legal options.

First, you must have no other criminal convictions on your record. Second, more than five years must have passed since your last date of probation or parole. Third, you must make an appropriate application, including requesting records from the state police and FBI and finally, everything is left to the judge's discretion.
