Michigan calls the conduct "criminal sexual conduct", and it is split into 4 "degrees" depending on the case facts. One fact/issue may be if the victim was intoxicated or "incapacitated", which would probably require proof that the person was so-called "passed out drunk" or intoxicated to the point that hse/he could not defend her/himself or make a rational choice to consent to the conduct being inflicted on her/his body. But from your limited information, the amount of alcohol involved and the extent of intoxication cannot be determined.
