Disorderly conduct while unconscious?
About a week ago, my husband went to a graduation party a few blocks from our house. He rode his bike over there since he knew he would be drinking and didn�t want to drive. I spoke to him at 2:30 am and he said he was coming home, but by 3 he still wasn�t there. I started calling his cell phone, but no answer so I got in my car and went to look for him.
I found him around the corner from my home with 2 police officers and an ambulance; apparently they had a call that there was a man lying in the street. My husband was bleeding from the head and was disoriented, but the paramedics said that he didn�t need stitches. He had wiped out and was unconscious for a few minutes (at least long enough for someone to call and the paramedics to be sent out)
My husband just wanted to go lay down but the officers made him to stand there for another 15 minutes while they wrote him a ticket for public intoxication and disorderly conduct.
There was no Breathalyzer given, they just assumed that he was drunk, but over the last week he has been sleeping 10-12 hrs a day, so I believe he actually had a mild concussion (he still wouldn�t go to the doctor though, too embarrassed).
He has a good job, no prior tickets for anything
Should he fight this?

Disorderly conduct and public intox. are misdemeanors and stay on your record forever. He doesn't need this on his clean record; and not to mention the fines and costs that come with it, it may also have adverse effect on his present or future employment. Based on the facts you presented, he has a very good chance of beating these tickets and/or getting the misdemeanors reduced to civil infraction(s). In what city did this occur? And going to a doctor may actually help his defense.
