Legal Question in Criminal Law in Michigan
Disorderly Tresspassing and Defacation.
I was arrested for disorderly tresspassing and defacation. I had 8 drinks earlier in the night and blacked out for the period of 6 hours. When I came to, I realized i was pulling my pants up and an officer was asking me if I was ''sh$#ing''. She then also told me that I fit the description of someone arguing on the doorstep of someones home. I do not remember this. I was told by my free lawyer that was appointed by my college that this was severe and I could possible face jail time. Can they seriously put me in jail for this? What is the minimum penaltly I could get? I blew a .16 at the police station. I feel that I might have been drugged or had a reaction to something I ate earlier in the night. Can anyone offer advice?

Assuming you are over 21, (if you are not, then the officer would have also charged you with minor in possesion of alcohol), you might consider not doing this again. A lot of very bad things can happen to you and to others in an alcoholic blackout with jail being the least of your worries.
These are 90-93 day misdemeanors and the likelihood of you going to jail will be diminished if you can show the court that you consider these charges to be serious and you are taking action to see that it won't happen again.
If you're at the blackout stage, going to a few AA meetings would be helpful.

You could do up to 93 days in jail. It sounds to me like you have a problem with alcohol. Please feel free to contact my office to discuss the matter further. (800)LAW-6685 or www.michdui.com
