Diversion Program

A police report was filed against me last JUne for Larceny from a building. I did not do it and i told the police this. I just got a letter saying that i MUST appear at the Prosecutor's Diversion Program. What is this?? Do i take this 'diversion' eventhough i'm innocent?? help.

Most diversion programs result in a non record if successfully completed. If you do not complete succcessfully some programs then start criminal proceedings against you in others, where they require a guilty plea, you would have a conviction on your record and be subject to sentencing by the court. It depends on what type of diversion they are offering you. If you didn't commit the crime than request that they formally charge you and proceed to trial. You would be entitled to a court appointed attorney if you are unable to afford one and he/she should still be able to get you some sort of a plea bargain where, if you successfully complete probation, you will not have a record, if it appears to the attorney that you do not have a chance of winning at trial.
