Legal Question in Criminal Law in Michigan

Domestic Violence 2nd

I have a pending Domestic Violence(2nd) charge in Macomb Co. which is false, At my arraignment the judge entered my plea of not guilty, but he never asked me if I wanted a court appointed attorney. My pretrial date is sheduled for Nov. 6th 2007, and I am not sure what to do... This case is from June of this year and back at the time my girlfriend tried to go to the prosecutor several times to get the charge dismissed or dropped and the P.A. said that she couldn't. It was a heated arguement, that She(my girlfriend) will say that that was all it was and that she should have never called the police. But on the day that it happened she was still angry and exagerated her statement to the police. So now the police report is obviously what the sate is going by. So, I guess my question would be; Is there any chance I can get this case dismssed? If my girlfriend does not show up to court, will they dismiss it? Now that the state has picked it up?What exactly does the Prosecutor have to prove against me( using just the report) in order to make this stick? Do I really have a chance of getting this dropped? Thank you in advance for your time... Sincerely R.B.

Based on your narrative, there is little chance the charge will be dismissed at pretrial - especially if your girlfriend was the complainant for the first domestic. If she's done it twice, you need more then legal advice.

Ask for a court appointed attorney at your pretrial.
