Legal Question in Criminal Law in Michigan

drug test for a non drug charge at pre sentencing interview.

A couple months ago I got caught driving on a suspended license, when I went to court they lowered my charge to failure to show operators license. They made me come in for a pre sentencing interview and at the end of it they made me take a drug test, I tested positive. What can the judge add on to my sentence because of this? and was it legal for them to make me take a drug test even though the charge was not drug related and I had not yet been sentenced?

It is possible that you violated a bond condition by testing positive for drugs. Perhaps you did not have an experienced attorney helping you with your prior criminal case. That was a mistake. Don't make that same mistake again.

This is a good time to get yourself an attorney. Failure to display your license is a misdemeanor and the judge can sentence you to 93 days in jail. Novi is a tough court, but an attorney might be able to negotiate with the prosector and the judge to mitigate the damage of testing positive. While an attorney is expensive, it may save you a lot in the long run. I handled a similar case so if you need help, contact my office.
