Legal Question in Criminal Law in Michigan
Off duty Cop, Restricted Liscense
I'm on probation and have a restricted liscense. An off-duty cop allegedly saw me driving one day and i got a scheduled for a court apperance on that allegation. I plead not guilty so i have to go to court again. My question is does the cop have the ability just to say i drove and now i have to pay for it? I planned on fighting it fully. Do you have any advice?

Re: Off duty Cop, Restricted Liscense
You have to pay for it, it's the price of probation.
If you can't afford an attorney, see if attorneys are provided in your district for probation violations.
If you have proof you were elsewhere at the time he allegedly saw you allegedly driving, you're going to need it.
On the other hand, it may not be a big deal, depending upon the judge, so consult local counsel.
