Legal Question in Criminal Law in Michigan

Expungement

I was arrested due to a vindictive

girlfriend who accused me

of domestic violence. I was arrested

and booked in Eaton County of

Michigan. I met with the prosecutor a

week later and she informed me she

would be dropping the case because

it was clear this was vindictiveness,

on top of I'm a muscular young man

and my ex had no type of bruises,

abrasions, scars, etc. on her. Plus I

saved every document I had, text, E-

mails, and facebook messages of my

ex incriminating herself; death

threats to my family, how she would

pay me back for leaving her, constant

acts of harassment towards me, and

so on. So I was convicted of nothing

and shouldn't have been arrested in

the first place. Prior to this situation,

I have never been arrested in my life

or ever had any criminal encounter

with a police office since I was 17

when I received a minor speeding

ticket. I'm 22 now and this incident

with my ex happened when I was

21. I'm currently a senior at a private

University and have a 3.2 G.P.A and

plan on acquiring a full time position,

and beginning graduate school in the

fall at MSU. I don't want this to affect

my future, so my question is how will

I go about getting this expunged?

Re: Expungement

If you were never charged, there is nothing to expunge. You might want to have a lawyer fill out court form 235 on your behalf and ask the court to order your fingerprint and arrest cards destroyed. That way there will not be any record of the incident. If you need help with this, contact my office.

Re: Expungement

You won't have to get it expunged if you enter a plea under the the domestic violence act, i.e., it won't get into your record in the first place
