expungement

I pled no contest to burning of real property in Oct. 2007. I have an ouil conviction from Oct. 2006. Am I not eligible for expungement because of my previous conviction?

Probably not, but check with local counsel to see what the specific rules are for your state, and what the judges in your county are likely to do.

You cannot expunge ("set aside the conviction" for) either conviction. Expungments are limited to situations where a person has one and only one criminal conviction (misdemeanor or felony). Further, you have to wait more than 5 yrs after you are done with your court case (off probation/parole, out of jail/prison, etc.) before applying in the court of conviction to set aside the conviction.

You have 2 convictions, so you cannot expunge either one.
