Legal Question in Criminal Law in Michigan
Expungement of records from multiple states
I understand that in Michigan your record can only be expunged if it is the only conviction. My question is if that counts for any and all convictions or only those charges brought on by the State of Michigan. If a person has a conviction in Michigan and another state, does that disqualify them from the expungement process in Michigan?

The short answer to your questions is that out-of-state convictions can disqualify you from setting aside a single Michigan conviction.

When the Michigan State Police do the background check that's part of the statutory process, they can pick up out-of-state convictions. Plus, you must swear under oath that you have no other misdemeanor convictions, and no other pending criminal cases.
