Legal Question in Criminal Law in Michigan
I have one felony conviction on my record , a non violent crime. and one misdeamnor deemiing from the same charge. Can I get the felony conviction set aside , or sealed?

The short answer is, "No ... under current Michigan law". Current law allows a person to ask a court to set aside his/her "one & only" criminal conviction. You have more-than-one conviction (even tho they are frm the same event), so you are excluded from this opportunity. But, the legislature is considering a bill right now that could expand eligibility (as it did in its last term). Talk to your representative in Lansing that you support such a change in the law. the new bill would only expand eligibility for applying to the court for expungment / setting aside a conviction. Ultimately, it's still the judge's discretionary call to grant the request.
