Legal Question in Criminal Law in Michigan
A friend has been charged with identity theft based on a check with a forged signature. She has been advised that the cost for handwriting analysis is approx. $800. The defendant cannot afford this expense. Can she request that the court order this exam?

Her or her attorney can make the motion alleging that it is necessary for her defense and she does not have the funds to pay for it. Most judges will require a list of assets and liabilities to determine if the defendant is in fact indigent. If she does not currently have a lawyer, now would be the time to get her one. If she cannot afford to hire her own attorney, she can ask the court to appoint her one.
