Legal Question in Criminal Law in Michigan

Friend was falsely accused of rape. He has two confessions from the accuser saying she lied. These are in text message form and are from two different phones. He also has an eye-witness saying he was out of town during the incident. Is this enough to build a good case to have the charges dropped? Please and thank you for your time.

It depends on whether or not the police and/or prosecutor find the alibi witness and the victim's change of story to be credible. If they believe that both are lying they can proceed. However, such evidence can and should be used to establish reasonable doubt and attack the credibility of the victim. "He has two confessions from the accuser saying she lied." Oh, really? Those messages better be directly traced to HER (the victim's) phone.

"He also has an eye-witness saying he was out of town." If this buddy of his is lying, they both may end up sharing the same cell. Oh, does his friend also have an alibi?

Seen the results from any testing of the victim yet?
