my boyfriend was charged with felonious assault and assault with intent to do great bodily harm less than murder. the charges were dropped but the prosecuting attorney recharged him with the same charges and his bail was set higher this time. are they allowed to that and if so how many more times can they continue to charge him with the same crime before the courts enough

Your boyfriend should get a tough, experienced lawyer to fight this case and try to put this to bed, once and for all. This is ridiculous.
Our firm recently wont a very similar jury trial. We'd be please to speak with you and your boyfriend on Monday. Call us at 1 8667665245.

There is no magic number. The more important question (not answered by the facts in your inquiry) is why the original charges were dismissed. Many times, if witnesses do not show for a trial, the court will dismiss the case "without prejudice" ... meaning that the charges can be re-issued.
