Legal Question in Criminal Law in Michigan
My girlfriend and a friend of hers were leaving one party to go to another. The friend left his backpack in the car and the backpack, unknowingly to my girlfriend, contained some amount of marijuana. The friend later ended up getting a ride home with somebody else. My girlfriend now has a backpack with marijuana in it in her car. My questions is, if she were to get pulled over and/or searched, how liable would she be for the contents of the backpack? Also, if she could prove somehow that the backpack did not belong to her, would it help?

The law against knowingly possessing an illegal substance is like the law of gravity - there are no exceptions, i.e. 1. She possesses it. 2. She knows it. 3. She's breaking the law.
No, don't call the friend and have her retrieve the weed - just get rid of it. Or, have you already smoked enough to prompt your lame inquiry?
