Legal Question in Criminal Law in Michigan

My girlfriend is still legally married bujt seperated. He was not on the lease at the house we ere staying in considering he moved out weeks before and signed a lease for a different home 3 blocks away. Either way, he broke inton the house while me and other room mates were sleeping and sexually assaulted my girlfriend. We called the cops and they said he would be charged with sexual misconduct and home invasion punishable by life. it scared her to put her son;s father in prison for life, so she dropped the sexual misconduct charges. Somehow, the charge got dropped to b/e illegal entry. My question is, due to the intent to committ assault, commiting assault, entering the dwellin while other people were legally there constitute this as first degree home invasion? He has friends in the local police and I think that is how he as done this. Either way, Does this crime constitute as first degree home invasion?
