Legal Question in Criminal Law in Michigan

need good help

My boyfriend and I were staying at some friends house and there other tenant who lives with them came home and freaked out about someone drinking her pop,her and my b-friend got into an argument and we left ,she called the cops.They came and did nothing, we left.Four days later we went back over to the house with the other friends that live there and were having a nice time,she showed up and apologized for everything so we thought stuff was good, then a few days later we were over there again and my b-friend was walking back to the house and the cops arrested him for home invasion at that house for the day that they had the argument,we all were there and we were invited we stayed there the previous night.He is being falsely accused of this cuz if he did a home invasion there then I guess I did too since we both stayed there the same nights.How can they do this when he had permission to stay and we were there with them?Can they charge him with that with no evidence?I think she's just mad about him eating her stuff and is doing this to hurt him.How do we get this resolved and if we can't how long is he gonna have to stay in jail?Is this a misdimeanor or a felony?Please help us this is unfair...
