Legal Question in Criminal Law in Michigan

Harrassment

I have requested a former lover to cease all contact with me. The person still emails, calls and text messages me although I have asked them to stop. I have a log of the contacts and the gift that the person sent me. They have not been mean or violent in any way. Can I have this person arrested or press criminal charges? What would my next step be.

Yes, that is harrassment. It is called stalking. Contact your local police department.

You can apply to the court for a personal protection order or for a peace bond. Your attorney can assist you with the process.

Both prior answers are correct.

1) This qualifies as "stalking" under Michigan law. See the definition at my office's web site (www.prosecutingattorney.info .... click on the Definitions button ... go down to Stalking). Stalking is a crime. Police should investigate it. That alone might get the person to stop the acts. It's possible that a prosecutor might issue a charge, too. Your cooperation will be critical.

2) You might be able to get a PPO (Personal Protection Order) to stop continued harassment. At our same web site, click on the PPO button to read detailed info on PPOs, to download all the forms, etc. Talk to your local prosecutor about what to put in your PPO paperwork in order to tell the full story so the judge reviewing your pleadings will give your case a fair shake. The is no filing fee at the court for getting a PPO, but PPOs do have to be served on defendants, and you might need to pay a nominal fee to a process server to see that that's done.
