Legal Question in Criminal Law in Michigan

my husband is being charged with felony controlled substance possession, he did not have the pills on him i gave the 3 pills to the first reponse, why did they arrest him 1 week later not right than, and he is also charged with consumsion no blood or urine test was done and the first reponse seen no reason to take him..my questions are can he be charged w/ possession not have the pills on him , and how can they charge him w/no tests for consumtiom?
