Legal Question in Criminal Law in Michigan
My husband had a trail, he requested a new trail, the judge granted it. The case then went to our state's court of appeals (the prosecutor appealed). It has gone threw the court of appeals and the COA kicked it back to the trail court. Their ruling was for the trail court to set a new trail within 55 days of the notice of a new trail. It has been almost a month since then, what will happen if a new trail isnt set up?

It should be in the Court of Appeals opinion: If a new trial is not set within 55 days of the date of the opinion, the charges should be dismissed.
